The 2018 Farm bill defines hemp as “the Cannabis sativa L. and any part of the plant with a Delta-9 Concentration of not more than .3 percent by dry weight” which is what allows the cultivation of cannabis and cannabis products as well as sale, distribution and use of these products as well, provided that they contain less that .3% Delta-9 THC on a dry weight basis.
