Federal Changes Coming to Hemp - A letter from the Owner
Federal Definition of Hemp Changes take effect December, 11th
Hey buds, Drew here! It's been a long while since we have written blog posts or made any content outside of our usual weekly emails. We have been busy. It's nice to sit down to write something; unfortunately, this entry into our CBD and Hemp Education blog isn’t a very jolly one.
December 11th, 2026 is a very important date for hemp this year. If there are no legislative changes at the federal level, December 11th could mark the end of the federally legal hemp industry as we know it, prohibiting the sale of nearly all the products we've spent the last five years bringing to you.
As of Today, 11/3/2026, Best Buds final day for shipping is December 7th, 2026.
What’s Changing?
We have not been sounding the alarm on this, as we very well could be moving right along come December 11th, having great days and spreading great products to you all. There is still time for legislative changes to again extend the current hemp laws, or for new, more robust hemp laws to be implemented. What those may look like, we are clueless. What happens in December?
Under the new Federal Hemp Definitions, qualifying hemp products must contain less than .4 MG THC Per Container. This prohibits the sale of all THCA and CBD Flower, all THC Gummies, THC Beverages, Concentrates, Full-Spectrum CBD oil, and pretty much everything else that we offer. As far as Best Buds products go, we have a lone ranger that may make it through the new laws: our CBD Isolate Gummies.
We have some new drops scheduled, and we have some fun things to share before now and December 7th. However, if there are must haves that are currently listed on our menu, we highly suggest scooping what you have your eyes on sooner than later.
What Happened?
During the negotiations of last years Federal Funding Bill negotiations, new language was tucked into the budget bill to redefine what differentiates hemp from marijuana. The new language bans the sale of hemp products containing more than 0.4 milligrams of total THC per container, thus banning the majority of the products that customers love, and things like Full Spectrum CBD Oil that people depend on.
The original text set the new rules to begin on November 12, 2026. This date was then delayed in September for the new laws to take effect on December, 11th 2026, a 29-day delay. This also happens to be the same day that this year's budget bill is supposed to be completed. This bill could contain new language that favors the industry. It could keep flower and concentrates alive, or it could ban everything, including CBD Gummies.
Our Thoughts…
Honestly, we're unsure of where things go from here. We have spent half a decade building our little family business; we hate the idea of losing what we have built. We hate the idea of everyone going back to the black market, because let's be honest, this change isn't going to prevent people from getting cannabis. It's just going to change how people get their cannabis.
We also hate the idea of shutting our business down, laying off employees, and turning our customers away from a place they have grown to love and trust.
What do we love? Everything that we have done for the cannabis community, and the community we have built over the last 5 years. All the lives we have changed, the people we have helped, and the parties we’ve been to without stepping through the door. Best Buds has become everything we wanted cannabis to be when we're working… in different avenues.
We are eternally grateful for every order. Every customer. Every store that puts our goods on your shelves. Without the support of our community, we wouldn’t have been able to create dependable jobs and change lives. We love you all so very much, from the bottom of our big Best Buds hearts. We hope to serve you for decades to come. <3
